Migrationsrätten är ett viktigt område som ofta berör frågor om mänskliga rättigheter.
Asyl
En utländsk medborgare som flytt från sitt hemland på grund av förföljelse kan söka asyl i Sverige. Ansökan lämnas till Migrationsverket som handlägger ärendet. Migrationsverket kan förordna ett offentligt biträde och den som söker asyl kan själv föreslå en jurist. Det offentliga biträdets uppgift är att ta tillvara den sökandes rättigheter, att förklara för sin klient hur handläggningen går till och vara närvarande vid asylutredningen på Migrationsverket. Biträdet skriver ett yttrande till Migrationsverket och om ansökan avslås kan biträdet överklaga till domstol. Det är viktigt att biträdet har kunskap inte bara om den svenska Utlänningslagen utan även om internationella konventioner som reglerar rätten till asyl och mänskliga rättigheter. Kostnaden för det offentliga biträdet betalas av staten.
Arbetstillstånd, uppehållstillstånd, uppehållsrätt och svenskt medborgarskap
Vi på Din Advokat kan hjälpa till med att ansöka om arbetstillstånd, uppehållstillstånd på grund av anknytning till en person som bor i Sverige och svenskt medborgarskap. EU-medborgare eller icke-EU-medborgare som bott i ett EU-land och vill flytta till Sverige kan vi också hjälpa. Något offentligt biträde förordnas inte i dessa ärenden. Det betyder att man måste betala själv för våra tjänster. Ofta kan det räcka med en kortare konsultation.

Asylum
Foreign citizens who have fled their home country because of persecution or other dangers can apply for asylum in Sweden. The asylum application is submitted to the Swedish Migration Board. The Swedish Migration Board appoints a public counsel in the majority of cases. Anyone seeking asylum may propose a lawyer to represent them in their case. The public counsel's duty is to ensure the applicant's rights, to explain the nature of the proceedings to his/her client and be present at the asylum investigation. Before the Swedish Migration Board makes a decision the public counsel writes a statement. If an application is denied the applicant have the right to appeal to the Migration Court.
It’s important that the public counsellors have knowledge not only of the migration law but also of international conventions governing the right to asylum and human rights. The cost of the public counsel paid by the state.
